Terms of Service

These Terms of Service (“Terms”) govern your access to and use of nativerefuge.com and the Native Refuge native-plant report service (the “Service”), operated by Native Refuge (“Native Refuge,” “we,” “us,” or “our”), the trade name of a California limited liability company. By using the Service or purchasing a report, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Native Refuge generates a property-specific report of California-native plant recommendations selected for a location you provide, along with related tools such as a plant list, a plan builder, and a printable nursery list. The report is provided for general informational and educational purposes (see “Informational use only” below).

2. Accounts

You may need an account to purchase or access a report. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for activity under your account. Notify us at hello@nativerefuge.com of any unauthorized use.

3. Purchases & pricing

Reports are sold for a one-time fee shown at checkout (for example, $40 for a single report; multi-report bundles may be offered). Payments are processed by Stripe, and by purchasing you authorize the charge and agree to Stripe’s terms. Prices may change, but changes do not affect reports you have already purchased.

4. Refunds

Reports are digital products delivered immediately, so all sales are final and purchases are non-refundable, except where a refund is required by applicable law. If you were charged in error or your report failed to generate, email hello@nativerefuge.com and we will look into it.

5. Informational use only — no professional advice

The Service provides general horticultural and ecological information to help you choose native plants. It is not professional landscaping, horticultural, arboricultural, environmental, legal, or safety advice, and it is not a substitute for consulting a qualified professional. Plant and ecological data is compiled from public and third-party sources and may contain errors, omissions, or out-of-date information.

Some plants can be toxic or harmful to people, pets, or livestock, may be invasive in certain settings, or may be unsuitable for your specific site. Always verify a plant’s suitability, safety, and toxicity from authoritative sources and use your own judgment before purchasing, planting, handling, or consuming any plant. You are solely responsible for decisions you make based on the Service.

6. Acceptable use

You agree not to:

• resell, redistribute, or publicly post reports or data, except for your own personal gardening and landscaping use;
• scrape, crawl, or bulk-extract content from the Service;
• reverse-engineer, disrupt, or interfere with the Service; or
• use the Service unlawfully or to infringe the rights of others.

7. Intellectual property

The Service — including its compilation, ranking, design, and written content — is owned by Native Refuge and protected by intellectual- property laws. We grant you a personal, non-exclusive, non-transferable license to use the report(s) you purchase for your own gardening and landscaping purposes. Underlying plant, ecological, and imagery data is sourced from third parties (see our Methodology page) and remains subject to those sources and their licenses.

8. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that recommended plants will be accurate, available at nurseries, or suitable for your site.

9. Limitation of liability

To the maximum extent permitted by law, Native Refuge will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of plants, property, profits, or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the report giving rise to the claim.

10. Indemnification

You agree to indemnify and hold Native Refuge harmless from claims, damages, and expenses arising out of your misuse of the Service or your violation of these Terms.

11. Changes

We may modify the Service or these Terms. We will update the “Last updated” date above, and material changes are effective when posted. Your continued use of the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. You agree to the exclusive jurisdiction of the state and federal courts located in California for any dispute, subject to any consumer-protection laws that give you the right to bring claims elsewhere.

13. General

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service and supersede any prior agreements.
